Chapter 7 - Liquidation

Chapter 13 - Debt Adjustment

Samson & Associates is also prepared to assist those who may be better served by retaining some liability on a portion of their debt or obligations and, at the same time, keeping their property through the Chapter 13 Bankruptcy process. For many, a Chapter 13 Bankruptcy provides the means to retain property, such as one's home, vehicles, and other high value assets, and still pursue their right to relief from debt under the Federal Bankruptcy Code.

While there are numerous advantages and disadvantages, some common benefits of Chapter 13 Bankruptcy include the ability to receive complete release of liability for a 2nd, 3rd, or subsequent mortgage liens, while retaining one's home and other valuable property. Additionally, many individuals can compel their mortgage lender to accept arrearage payments and remain in their home under an approved plan.

Chapter 11 - Reorganization

Samson & Associates is further able to represent businesses, including corporations, partnerships, and sole proprietorships, in Chapter 11 Bankruptcy proceedings. Each business is unique, with various forms of assets and liabilities. Successful reorganization in Chapter 11 Bankruptcy proceedings requires personal attention to each of the multitude of these unique factors.
